No ... that was the essence and underpinning of Judge Sauls ruling. To overcome the Gore team assertion for a de novo review ... Judge Sauls had to give authority of review to some other body other than the courts which he did in his ruling by supporting the canvassing boards authority. I do not think most people realize what a BLOW Judge Sauls rendered when he made his decision on a finding of fact (term of art). The review standard to overturn such a finding is much more difficult than a finding on the law. I particularly liked the hand slapping he gave to the State's Attorney General. Keep ypur eyes on Seminal (sp?) County ... don't think it would hold on appeal, but one never can anticipate a Judge's ruling.
