CellPro openly challenged a patent that Applied Immune Sciences (now a part of Rhone-Poulenc Rorer) chose to license. I had just done a stint at SyStemix, and the patent and issues surrounding it were very much on my radar. The CPRO stance seemed, to me, to be arrogant. This is not hindsight..... I considered their strategy to have been unwise, from the beginning.

What companies do I respect for patents? Many, including MCDE (but, again, it's a very early story at MCDE). Try looking at PDLI. GNE has used patents for text-book strategic maneuvering. Murky and difficult to enforce? While I don't see them as murky, I do think that you will enjoy following the TKTX versus AMGN story as it unfolds.

Your choice to discuss CPRO is of interest. It is of primary importance that an investor first determine that his company actually has rights to practice a relevant art. For years, informed investors have looked at CPRO and said "huh?". Beware of moustaches that grow smaller as objectives slip away.

A call to IR at MCDE will perhaps yield a complete discussion regarding patent strategy and stance. If you call them, please let us know what they have to say.

If you feel that biotech patents are murky and difficult to enforce, why are you investing in the sector? Patents are all we've got. :-)
