But if some court ruling results in a win for Gore, such that Gore's electors are certified by midnight Dec. 11, then the legislature would be overreaching to intervene, would it not? Seems like the moral high ground is to intervene only if there is a danger of having no electors seated by the deadline, and then only if their act seats the most recently-certified electors (whoever they are) at the time of enactment. In other words, it would be a dangerous precedent to flatly seat a slate of Bush electors simply because they don't like the results of a court ruling, eh?
