Boies presented an affidavit about the Illinois case that was later recanted.

The Florida Supreme Court cited the case in its opinion with the implicit message that dimpled ballots should be counted.

Boies than made similar representations to the canvassing board where Judge Burton was sitting. As you know, Judge Sauls had a lot of respect for Judge Burton, which I think provided a linchpin for his thought processes.

My cynical nature prompts me to think that Boies was well aware that he was stretching it with that affidavit. I'm also unaware of any efforts he made to withdraw it. The complaint to the bar was replete with news references showing the inaccuracy.

Unfortunately, there are many people, lawyers and non-lawyers alike, who engage in such shoddy tactics.
I always figure you're safer with the truth. The truth has
a sort of natural consistency to it. I can usually
deal with the bad aspects of the truth because
I have a certain flair for positive spin. :-)
