The lawyer who made the attestation was quoted somewhere here locally as saying when first contacted he remembered it the way the affidavit said, but on reflection and talking to opposing counsel he realized the judge had rejected that argument. The judge in that case, BTW, was pretty good by Chicago standards.... I remember appearing before him a couple of times.

So Day 1 and maybe Day 2 Boies was ok... but once he was told the affidavit was no good he should have sent a member of the Army of Lawyers in to set things straight.

Maybe he intended to get around to it..... on December 19.
