GMST--EchoStar duels with Gemstar in court

LITTLETON, Colo. (CBS.MW) -- Direct broadcast satellite provider EchoStar announced late Tuesday it has filed suit against Gemstar-TV Guide International and its subsidiaries for allegedly violating state and federal antitrust laws.
In a suit filed in the Federal District of Colorado, EchoStar alleges Gemstar's licensing practices violate antitrust laws and laws governing unfair competition, particularly its practices involving its interactive program guide technology.

In addition, EchoStar filed counterclaims in a patent infringement suit filed by Gemstar in North Carolina Federal Court. In the counterclaims, EchoStar attacked the validity and enforceability of the Gemstar patent.

Gemstar is a provider of interactive television programming guides and e-books and the creator of the VCR Plus programming device. Gemstar profits from the guides through licensing and ad sales. They are widely licensed by other companies, and the company vigorously defends its patents.

Shares of EchoStar (DISH: news, msgs) rose nearly 5 percent to $29 Tuesday, while those of Gemstar (GMST: news, msgs) soared 13 percent to $45.63.

Gemstar could not be immediately reached for comment.
