Ah, but you are thinking rationally, not as a lawyer. <g>

The appellate courts generally are not supposed to do their own research in our adversary system, they are supposed to let the adversaries dig everything up. Cases are supposed to be decided on the evidence before the court and appeals by the "record" of the case in the lower court.

I was always amazed in law school how getting the right answer was so easily allowed to get lost in the process sometimes.
