Barry, re: "Out here in CA we had a rather activist partisan court when Rose Bird was presiding. I've heard comparisons of the FLSC to her court as being MORE activist and partisan." They are VERY activist. But in this situatation, do you really think that these folks are making a partisan decision? They are making history, I have to assume that they realize the scrutiny that will follow. These are not people off the street, they are lawyers that have reached the top of their profession because of their ability to make important decisions. You can disagree, as the minority did, but I think it's unfair to say these folks have given up their objectivity, in the face of a historic decision, for a political objective. John
