You're right, of course, re the Supreme Court, but there are also lower court appointments that are not so bitterly contested.

And the complexion of congress could also change, not dramatically perhaps, but enough to make some difference, either way, in just two short years. Bland would much prefer to see the nominations come from the party less inclined to judicial activism.
