Hiya JW,

Right now the USSC has asked for briefs by 7.00 am today morning. I believe that that means that at the earliest they would hear the case tomorrow morning rendering a decision by Monday sometime. The problem for all Bush folks is this... By tomorrow, the reality on the ground could have shifted in Gore's favor, and the USSC MUST be aware of the political situation on the ground. I don't know if that would stay their hand - it would certainly be something they would need to consider... If Gore pulls out ahead and the USSC vacate the FLSC decision, it would be perceived to be a unfair and the Dems can present it as such...

About the only two ways to get around this is for an immediate stay by Justice Kennedy, or the Circuit court, or if Bush somehow manages to stay ahead...

Regards...
