What you say is appears reasonable, but James B's response is correct. Even the Legislature can't change the rules in the middle of the game. Furthermore, and I think more significantly, as Gore spoke of his reasonable offer, he was in fact seeking something reprehensible behind the podium. That this man EVER sought such a count favoring himself, let alone in reality simultaneously with his words of fairness, is so distasteful that....that...that...Oh well. I can't blame Bush for not dealing with such a man. Bush was under no obligation to seek another count beyond the rules, putting his own voters in possible jeapordy.

Half of the voters voted for Bush. Gore started and finished, trying to seek unfair advantage. You know the drill. Territorial Gore counting advantages claimed as providing a fair result. Kick out oversees and absentee ballots favoring Bush if possible. Anything favoring him. All these actions were moving forward as he made his "offer," and would have surely continued if Bush had accepted, while waiting to see if some scenario like your's could be put in place simultaneously.
