Seems to me that the ruling, which overturned another ruling, kept Gore in the game. I'd call that a ruling for Gore.
OTOH, this isn't about fairness. It's about war. War between one set of Lawyers and Judges vs another set of Lawyers and Judges. Those with experience in litigation saw this coming a long time ago.
No one seems in a position to weigh all the facts and render a fair judgement here. Had Gore been a Statesman, he would have realized this and would have conceded after the 2nd recount. Instead, tempers flair, otherwise nice people are labeled and threatened and raw feelings divide further divide the country.
