It may still happen. Scalia's language, and the US Supreme Court in general seem to be more concerned in large part with the method rather than the count. It is unfortunate that the media...as usual... is using the most outspoken (conservative) Justice's remarks to quantify and misrepresent the case.

It has been largely ignored in the press that often a "courtesy vote" is extended by one of the U.S Justices to hear further arguments before passing down a ruling in deference to the court... I believe this is what happened here.

The court could ultimately order re-counts to resume with clear standards in place... and perhaps even extend the Dec. 12th date for naming electors.

In an effort to stay semi on topic here as this relates to market direction... I still believe Gore has a 50/50 chance of winning the election, and the market has a 50/50 chance of tanking hard early next week. This could be a great opportunity for a retest, or lower lows to be put in.

Regardless, volatility will reign supreme.
