I didn't say there have never been cases where dimples were not considered, or possibly even counted as votes. I said there has never been a case that said they automatically WERE votes.

The Palm Beach standard was PERFECTLY fair, imo. And it included looking at dimpled ballots and considering the totality of the ballot. Boise and co. wanted the judge to say they COULD not do this. A dimple IS a vote. How is that fair, or did I watch the wrong trial?

Also, the IL case that Boise sighted to the FL SC and to Judge Sauls DID NOT count the dimpled ballots as votes in the end. He worded it in such a way that it left the impression that they were counted as votes. I think they retracted that falsehood, but if I was the judge looking at it I would have been pissed. I know that as a concerned citizen I was.

Last but not least, I bet that when the Broward county ballots are looked at they will be deemed to be the MOST liberally interpreted ballots (regarding dimples) ever in the history of the U.S.
