Laurence Tribe is a master at customizing elegant arguments to tread a narrow path so that a majority of the court feels comfortable going along, even when the odds seem desperately against him, but can Tribe do it this time? What arguments will he make in an effort to peel away O'Connor or Kennedy from their right-wing brethern when those two already seem to be so committed to a dangerous and destructive course of action?
