I read an article awhile back in which the author said the Left has been at war with the Constitution throughout this century. The assertion didn't surprise me, but he went on to say that the Right has been at war with the Constitution since 1803. That surprised me. He explained that Marbury v. Madison imposed judicial review, a new doctrine unforeseen by the framers. The court gave itself the right to overturn Federal laws. The author went on to talk about how the Federalist Party's supreme politician, Chief Justice John Marshall, hamstrung the Jeffersonians for over three decades.

I think you're right when you say there should have been a rebellion right there.
