All this evidence points to the conclusion that the majority of voters believed they were voting for Gore. Thus the exit polls and the CNN turnaround.


Thus we should dispense with the error prone voting process and divine the "will of the people" through sampling, punditry, and anecdote.

Except in the cases where the people doing such divining don't themselves reflect them will of the people, in which case we will defer to jurisprudence.

Except in the cases when those jurors defy comity by relying on an overly strict interpretation of the law, or when jurors put partisan considerations over legal principle, in which circumstances we should defer to the will of the people itself.
