If they blow off overvotes, what about the hypothetical where somebody voted for Bush and also punched "write in" and wrote in Bush? What if somebody had punched Gore, then punched Bush, and circled Bush, with a note that they'd only punched Gore by accident? And, what state-wide standard do they choose, and on what grounds? Wouldn't the Supremes be superlegislating?

Blowing off the overvotes would be a mistake. It's only solving one portion of the problem.

All are unattractive choices. It's going to be a choice of the lesser of at least 5 evils. A remand blows FL's safe harbor, and after granting the stay on Saturday would make the Supremes look bad.
