The Supreme Ct has a tough problem. At least half the people in the country think their stopping the manual recount was mostly for political reasons. If they give Bush an outright victory by a 5-4 vote, their credability and image suffers great damage. The next Supreme Court appointment becomes an all out war - much more intense than the Bork appointment.
