I have not seen any Florida statute or any court interpretation that says you can not count dimples under any circumstance. The clear indication of voter intent is contained in section 101.5614(5) of the Florida election code and discussed by the Fla Supreme court on page 23 of its opinion.

The Palm Beach circuit court did issued a decision with guidelines on when to count dimples and the Palm Beach Canvassing Board followed that standard.
