It seems to me that setting specifications for interpretation of voter intent from the ballots, at this point in time, is truly changing the law after the election. Shouldn't the law, that the local election canvas determines the intent of the voter by their own logic, be the law that prevails before and after the election?

There is one standard that O'Connor touched on, and that was the voter instructions. I think it is a neutral standard, and it was agreed on prior to the elections.

Based on this standard, Broward and Palm Beach counties would have to be recounted, losing Gore 500 to 700 votes from those counties.
