Joe,
Well the Florida court responded to the US Supreme Court, if this makes a difference, I don't know.
Isn't it "changing the rules after the election" to overrule the Florida legislative standard of determining "clear voter intent"? It seems to me that the legislature gave all the discretion to the local board, and the review discretion for the contest to the Florida courts.
And on the Palm Beach standard, they were only counting dimples if there were dimples throughout the ballot, a pretty clear indication that the voter couldn't perform the act of punching out the chad, for whatever reason.
re: ". This would be the strictest standard, since the instrucions order that any hanging chads need to be removed by the voter (I believe, you tell me, since you voted there)."
When I voted with the puch card system, I didn't feel at all comfortable that the chads (I had never heard of chads at that point) had been removed. There wasn't a clear feel to it. I looked at the card, and saw that there were holes in the card, and put it in the box. I didn't think to check specific vote numbers, so maybe not all of my chads fell out. Can I sue someone???
Next time, it will take HOURS to vote, EVERYBODY will be checking their chads.
