I will grant that, in their obvious search for a decision that can garner 7 or more votes, they probably considered your solution. I doubt, however, it took them more than the time required to read it to reject it as so impractical that it would make the USSC a laughingstock. If they spent any more time than that on it, I have no doubt that Rhenquist, Scalia, and Thomas lined up and convinced the other 6 to get back to the serious business of making a decision. Whatever they come up with, I think they have already buried the absurd idea of counting ballots for the 4th or 5th time. It REALLY smells, even to many Gore supporters. And it also doesn't do anything to settle the Court's biggest beef in all this: That some pissant state SC got a specific request from a Court that was trying to be deferential, and tossed it aside, and continued to create power for themselves out of thin air. I think that at least 4 Justices are pissed-off enough about the FLSC to make SURE there are at least 2 others who will help overturn them...
