I am under the impression it gives them the discretion to count a machine-rejected vote, so long as the clear intent of the voter is apparent.

They don't have discretion to count votes where the intent is not clear. If someone held a gun to your head and showed you a dimpled vote and said "tell me the clear intent of the voter or I will shoot you", how confident would you be?
