SUPREME COURT UPDATE: Why their decision is very tough, imho.

Still quiet, Market volume is way down as we all await their decision. Make no mistake, they are in a tough position and they know it.

They certainly want to come up with a decision with more than a 5 to 4 majority. After all, such a slim majority sends a divided and weak message to Americans and the world. They know that.

But how do they resolve this?

They look like weaklings if they remand back to the FL Supreme Court (again).

They probably can't establish new recounting standards because that changes the FL law which mandates each county estabablish their own standards (if for no other reason, because of the differing quality voting machines).

They also won't look good if they forbid the recount because they know it will make them look partisan (i.e. that they essentially decided the election), plus the courts generally are in favor of having as many votes count as possible.

They are earning their money this week and stuck with a dilemma they surely don't want. They know their own legacy is at stake, let alone the next President.

Probably the best thing for the country would be if the recount continued with reasonable standards and Bush still won, but we may never get that far.
