Well, the FSC has ruled that the undervotes are legal votes in the State of Florida if there is a clear indication of intent. This is not new law, it has been the law for quite some time.

So, basically you are arguing that your vote has been diluted by taking into account other legal votes, and that therefore you have been denied equal protection under the law.

Let's see how else that can be applied. When Congress passed the Voting Rights Act, and many black people were free to vote for the first time, were the white people deprived of equal protection because their votes were "diluted"?

Of course not. It is impossible for the counting of legal votes to result in a violation of the 14th amendment.
