Yes, but the constitutional conflict is that differing standards violates the equal protection promised under the U.S. Constitution. You can't get a legal recount under unconstitutional laws.

And the catch 22 is that you can't rewrite the law after 6 days prior to the election. The handcount is dead, long live the machine count.
