How can it be clear Bush lost the popular vote if you buy the Democrat's argument that all the votes must be counted? Nationally, 2 Million votes were apparently "never counted" because they were declared an overvote or undervote.

Regarding Florida, the only thing that's clear is that the Democrats made a tactical error in fighting only for standardless "selective recounts" rather than standards based statewide recounts. The entire case was opportunistic rather than principled.

The Democrats should have fought for a "fair and accurate" recount to begin with... they chose not to. The only fair and as close to accurate way to recount all the ballots is to perform a completely contiguous statewide recount from beginning to end with machine counts supplimented by hand counts using standards for the two main classes of ballots, punch and optical which could have been set by the Florida Supreme Court.

This could have been completed more than once over the last month had the Democratic legal team chosen this path. My question is, why didn't they choose this path? What were they afraid of? Although the Republicans would have fought it, it's clear now that it would have held up in the supreme court.
