A decision that merely states correctly and beyond doubt that recent FSP action violates the Constitution? I was shocked that the dissenting side were unable to provide a more convincing discription of how the FLSC's did not violate constitutional guarantees. I think the majority opinion was VERY clear in laying out their argument for reverting "to the mean" with regard to the definition of a legal vote (machine count) and disallowing arbitrary standards for counting votes (as evidenced by the testimony from Broward where 3 different people came up with 3 different opinions as to whether one ballot constituted a "legal vote". For "clear intent of the voter" standards to be utilized, there can not be ANY subjectivity in discerning the vote. You don't look at a ballot, see that they voted for one party with regard to all non-presidential candidates, but due to under/overvote problems, try to suggest that they thus meant to vote for one candidate or the other. It just doesn't make rational sense and it's a crappy way to try to win an election. Thank god the majority of the USSC had the cajones to stand up for the law and equality in voting standards.
