You both basically said the same thing - that the above was the point of law that was argued. This was the law that was upheld and I agree with it. Note that your answers don't address the bigger picture about what should have been done and who could have effected it, they only address this technical aspect of the law. Is there anyone who feels that if a fair way to recount was found that it still shouldn't have been done?

Wouldn't it have been great if we could be saying right now that 36,000 of the 40,000 undervotes (or whatever number) had no vote for President. I will repeat...the harm was in not counting the votes, the outcome is independent of that.

OK, so you mean that it was fine for Bush to drag this into the courts and not attempt to arrive at a good way to recount because in his opinion it couldn't be done fairly, but Gore is a villain because he tried to get the court to have every vote counted. That doesn't make sense.

I hope he doesn't run the country this way!
