I think it was Rehnquist who pointed out to Boies that in some cases people may have punched the ballot not only for Bush but also punched the write-in category and then wrote in Bush's name. That may have happened in Duval County to Gore voters. In Duval, the sample ballot in the newspaper had all the presidential votes on one page but the actual ballot had them on two pages. Some blacks in Duval were claiming that they started voting from the back and got confused. The write-in portion of the ballot is behind the page with Gore's name on it. But Gore refused to request a manual recount in Duval county.
