The review of the ballots was being done by the canvassing boards. There was no judicial review of the ballots which is called for. T. Lewis instructions were clear that they (lawyers) could not object to a specific ballot. This was a clear concern of SCOTUS. They were also concerned that the remedy did not allow time for appeal.
