Seven of the justices, including liberals Souter and Breyer, agreed that the manual recount procedure set up by the Florida Supreme Court violated the Equal Protection Clause. So that's not a political decision.

Scalia's opinion on the stay, that "suffice it to say" that a majority of the bench thinks the Plaintiff has a likelihood of prevailing could have been worded more tactfully, but it was an accurate statement of the law. There was no way they would have issued the stay if they intended to let the recount go on as it was, without any standards.
