That is my personal theory... that an IRA, if traded with continuity and regularity to the extent that substantial activity is spent seeking to profit from daily market movements in the prices of securities and not from dividends, interest, or capital appreciation then the IRA would be deemed to be operating the trade or business of a securities trader.

The operation of a trade or business by an IRA disqualifies the IRA... retroactively.
