I just searched for third degree relative and "civil law" and didn't find anything, but with just "third degree relative" I found lots of medical sites.

In medicine, at least, a third degree relative is a great-grandparent or cousin.

A second degree relative is a grandparent, aunt or uncle.

I don't know whether that's true in civil law.

If it is, the spouse of a cousin had better not have a material interest that could be substantially affected by the outcome of the proceeding.

Scalia's son(s) had a material interest (law firm partnership) that could be substantially affected by the outcome of the proceeding.

Could be and will.
