Good point about the partisan nature of the Supreme Court. Anyone who thinks otherwise is naive. Anyone who thinks Roe v. Wade wasn't judicial activism is ignorant, to cite an example we are all familiar with.

But constitutional scholars can point to many, many decisions which can only be explained by looking at the political philosophies of the Justices, going all the way back to Marbury v. Madison. Dred Scott is another famous one. Lochner is one that is famous among scholars, although it's not well known among the general populace.

I remember "Impeach Earl Warren" billboards all over the South when I was a kid. I guess they were probably mad about Brown v. Bd. of Education.
