1. Touting. The allegations in the action we brought

against Jeffrey Bruss and his company, the Future

SuperStock, Inc. (“FSS„)[25] demonstrate a Section 17(b)

touting violation. Beginning in the spring of 1996, a

newsletter published by Bruss and FSS recommended to more

than 100,000 subscribers the purchase of approximately 25

microcap stocks. The recommendations were also displayed on

FSS’s web site. The standard prediction was that the stock

price would double or triple within the next three to twelve

months. We allege, among other things, that neither Bruss

nor FSS disclosed the receipt of compensation from nearly

every issuer profiled. Our allegations also include that

FSS and Bruss represented that they performed independent

research and analysis in evaluating the issuers profiled

when, in fact, they conducted little, if any, research.
