Read Souter's and Breyer's dissents for the best possible critique of "sound reasoning" as it relates to Article II of the Constitution and Title 3 of the US Code. And they agreed that a remand was necessary on equal protection grounds, only they did not see the need to stay the count and put a bullet in Gore's head in order to address that concern. While you are at it, as long as you contend that a 7-2 majority saw what the FSC did as unconstitutional, you might also consider that 6 of the 9 justices thought that there was nothing impermissible about manual recounts, only 2 of the 6 didn't think there was enough time to complete them so they ended it -- based on an artificial deadline no less.

Rarely has so important a decision, where the Supremes typically strive for unanimity if at all possible, resulted in such a divided Court. You owe it to yourself to read the dissenting opinions written by Republicans Souter and Stevens -- who are anything BUT democratic partisans. Don't listen to a democrat, listen to what an intellectually honest republican said in dissent of the opinion.
