Looks on its face to be a just result given there has already been a finding of trade secret misappropriation (by patent counsel, oooh....that was bad...probably no indemnification for that one). Frankly if I had known Calp sought a constructive trust as its remedy I might have been less optimistic, and I'm glad the court had, and exercised, its equitable powers to do the right thing.

The real news, buried in aclara's PR, however makes me think the only value of '015 to aclara was to enjoin calp's use, which of course means aclara lost big time:

Next, calp proceeds to assert its IP against aclara, unless the rulings on T-intersections allowed the lawyers to work out an amicable arrangement in the meantime ha ha ha.

Then maybe someday, either company can show us that microfuidics can do a better job making money for investors than the manufacturers of chip arrays.
