5 justices said the votes should not be counted. 2 of those 5 had a family member with financial interest in the outcome. 1 of the 5 had expressed her dismay with a possible Gore victory.

In any case, as I have clearly established in prior posts on the subject, there is no equal protection argument. The justices who invented the equal protection argument did so because they lacked any semblance of a spine.

In years to come, people will spit whenever the greasy little justice Scalia's name gets mentioned.
