If SCOTUS had ruled in Gore's favor, it would have been to allow recounts not to name Gore winner. And no matter how you wish to spin it, those punch ballots were handled on several previous ocassions and were not meant to be counted by human eyes to begin with. Any "recount" would have been highly suspect as far as accuracy. Given all the charges and counter charges, it seems likely that the Congress would have intervened, except that the FL legislature would have removed the doubt the recounts would have created by stepping in to settle the matter anyway. The FL legislature is where this really belonged in the first instance and had the prerogatives of the legislature not been disturbed in the first instance by the FL SC, it would never have gotten as far nor become as bitter as it did.
