But that's not the basis upon which SCOTUS decided the case -- only 3 of the 9 justices thought the FSC had written new law that needed to be overturned. The other 2 judges in the majority did NOT agree, and limited their ruling to the equal protection issue -- which, in essence, takes offense to the FSC decision because they DIDN'T write new law, that is, adopt a more specific standard than the general standard adopted by the Florida Legislature.
