I think the suit would be to invalidate the vote for Carnahan because he was dead. That would mean that Ashcroft would win because he received the only valid votes.

I hadn't heard that the seat would be open in 2002. Why would that be so since the term should run for 6 years?

Well, it's too late now, but I think that the GOP was shy because they thought they would be hypocritical to challenge it in the courts while condemning Gore for doing the same.
