I'm not saying he won't get some tough questioning. He will definitely get that by Pat Leay and other lefties on the Judiciary Committee, but everybody knows that. Ashcroft certainly does, and he will make the points you made and many more. He is not a racist and nobody outside the looney left will accuse him of being one; certainly not his colleagues in the Senate.

The Senate is a very exclusive club and Ashcroft is a member... a good ole' boy (and girl) club. With the exception of John Tower's nomination as Defense Secretary the Senate has never failed to confirm one of its own to a cabinet position or Supreme Court appointment. The only Senator to ever fail Senate confirmation was John Tower, and he had been out of office for a few years and he certainly didn't have the impeccable character and integrity of John Ashcroft. He was a well-known womanizer and heavy drinker and the Dems used that as an excuse to shoot him down. The fact that the 2 most notorious womanizers and boozers in the Senate (Ted Kennedy and Chris Dodd) were both Dems who sat on the Judiciary Committee at that time is irrelevant to the Dems. Shameless hypocrisy is a virtue of the Dems.

The Dems on the Judiciary Committee have to make a show of looking tough on Ashcroft so they keep the goodwill of the left wing of their party. Ashcroft will get some tough questions but will be confirmed by a wide margin.
