For the analyst who makes buy and sell recommendations... how can he/she makes money (besides getting paid by commission) if he/she almost always maintain a buy or hold rating. When he/she liquidate the positions with a net gain, should SEC consider his/her buy and sell recommendation a contradictory evidence to his/her action? In another words, can investors file a class action to nail him/her to jail? JMHO
