Wrongo, TP. There was a 7-2 majority that said the Florida Supreme Court's recount violated the due process and equal protection clauses of the US Constitution. The 5-4 vote was in regards to the remedy. Breyer and Suitor (SP?), who voted with the majority in that decision, thought it should be sent back and remedied by the Florida Supreme Court under uniform recount standards. Exactly how this was supposed to happen when their decision was handed down on the deadline day for naming Florida's Electoral College Electors, they didn't say. The 5-4 vote was in regards to the remedy. 5 justices said it was over because Florida law required electors to be in place by December 12. The Gore crowd thinks they got screwed by a partisan 5-4 decision. Wrong. 7 justices said the recount was unconstitutional; the disagreement was on how to remedy the problem. 5 justices correctly said it couldn't be done by December 12 since that was the day the decision was handed down. Case closed.
