X, What you are talking about is motive. In one case the motive is racist hatred, in the other greed. Prosecuters take motive into account already in their choice of charge and juries know that it is a hate crime as opposed to a "mere" crime. Gradations of punishment follow, but IMO anything less than life without parole in either case would be a slap in the face of the victims and their families. Adding "hate" legislation on top is a can of worms. Every time perp and victim are from different groups there will be questions. Did he slug the guy and take his wallet because he was black or because he was handy? If the perp is white he gets five years for a "hate" mugging but if he's black he gets three years for a "regular" mugging? This type of law will spawn billable hours, for sure. ggggg
