JM, I don't think the issue with Ashcroft is racism. I think its a question of ethics. He blocked White's nomination claiming he was "pro-criminal" and "anti-death penalty". Reality was that White was very mainstream on the Mo. Supreme Court having voted more than 70% of the time AGAINST death penalty appeals(versus aboutg 60% for the rest of the court).

What really transpired here was that White had joined an opinion to throw out a conviction of a deranged man who killed several law enforcement folks. White made very clear that he was concerned that the defendant may not have been competent to stand trial, may have had severe mental illness that rendered him incapable of assisting his defense and that his counsel had not given him a competent defense because of this.

The law enforcement agencies in Mo. wanted this guy toasted because he killed some cops and White's nomination was supported by Gov. Carnahan(who had appointed him). Ashcroft very cynically decided that he could use this one case and the emotional outrage of the law enforcement community to get at Carnahan by branding "his guy" as a "pro-criminal" judge.

It was all election BS that Ashcroft tried to use to keep from losing his seat to Carnahan. That's your man of integrity and principle.

There is a lot more stuff about Ashcroft that really renders him unfit for AG, but, I doubt folks on this board would be interested in hearing it...
