Varian suffered another devastating loss on January 8, 2001 when the Honorable Judge Conrad L. Rushing denied Varians' Motion to Strike in his ruling filed in Santa Clara County Superior Court of California. The Varian plaintiffs lost their Motion to Strike Delfino's $50,000,000 class action lawsuit against Varian Medical (VAR), Varian Semiconductor (VSEA), Susan B. Felch & George Zdasiuk for videotaping Varian employees, their children, etc. using a Varian public bathroom.

Only time will tell how the Orrick Herrington & Sutcliffe partner, Lynne Hermle, representing the despicable Varian plaintiffs in their fascist SLAPP lawsuit against message board posters will recover from yet another huge loss in this case.
