It seems to me that the context of this example is important. I doubt that your state passed a law that says that directly and if they did, it wasn't at the instigation of the gays. I'll bet there's some old law on the books that speaks to those sinning heterosexual couples but doesn't mention homosexual couples because gays were below the radar of the bluenoses way back then. I'll bet you've got a state law that discriminates against one group but just never got around to discriminating against the gays. I don't have any particular knowledge of the gay political agenda, but I would be amazed if they wanted to deny housing to hetero couples.
